Terms of Service

These terms explain the promises we make to one another when you browse, create an account, or purchase a thoughtfully curated gift through our service.

These Terms of Service (the “Terms”) form a binding agreement between you and Thoughtfully Yours (“we”, “us”, or “our”). By using our website, applications, and related services (together, the “Service”), you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 18 years old, or the age of legal majority where you live, to make a purchase. If you use the Service on behalf of an organisation, you confirm that you have authority to bind it to these Terms.

Using our service

Thoughtfully Yours offers curated gifting products and related services. Product descriptions, imagery, recommendations, and availability may change as our collections evolve. We take care to present our offerings accurately, but colours and packaging may appear slightly different depending on your screen or because of seasonal or supplier changes.

Recommendations are provided for convenience and inspiration. You are responsible for checking that an item is suitable for its recipient, including any preferences, allergies, delivery restrictions, or other requirements you tell us about.

Orders, pricing, and availability

An order is an offer to buy. We may acknowledge receipt before we accept it. A contract for purchase is formed when we confirm acceptance or dispatch the order, whichever happens first. We may decline or cancel an order before acceptance because an item is unavailable, information is incorrect, payment cannot be authorised, or we reasonably suspect fraud or misuse. If we have already charged you, we will arrange a refund.

Prices are shown in the currency displayed at checkout. Any applicable taxes, delivery charges, recurring fees, and other costs will be shown before you confirm your purchase. If a pricing error is obvious, we may cancel the affected order and refund any amount paid after contacting you where practical.

Payments and payment providers

We use independent payment providers to securely process card, wallet, bank, and other supported payment methods. When you submit payment details, you authorise us and the relevant payment provider, bank, card network, or wallet provider to charge the total shown at checkout. Their own terms and privacy notices may also apply to the payment services they provide.

A note about your payment details

Sensitive payment credentials are collected and processed by our payment providers. We may receive and retain limited transaction information—such as your payment method type, billing details, payment status, and a masked account reference—to complete your order, provide support, prevent fraud, and meet our legal obligations.

Your payment may be declined, delayed, or subject to additional verification by a provider or financial institution. We are not responsible for their independent decision to decline a payment, but we will help you understand the status of an order where we reasonably can. Your bank or provider may charge currency conversion, international transaction, or other fees under its agreement with you.

Please contact us before starting a chargeback so we have an opportunity to resolve the issue. Nothing in these Terms limits your right to dispute an unauthorised or incorrect charge with your payment provider. Knowingly making a false or abusive payment dispute may lead us to suspend your account or recover amounts properly owed, where permitted by law.

Subscriptions and recurring payments

Where you choose a subscription or recurring gifting plan, its price, frequency, included benefits, and minimum commitment (if any) will be shown before you subscribe. By confirming, you authorise recurring charges to your selected payment method until the plan is cancelled or ends. We will provide any notice of renewal or price changes required by law.

You may cancel through the account tools made available to you or by contacting us. Unless checkout states otherwise, cancellation takes effect before the next billing cycle and does not reverse a charge already incurred or an order already being prepared. Your statutory cancellation and refund rights remain unaffected.

Delivery and recipients

Delivery dates are estimates unless we expressly agree to a guaranteed date. Delays may occur because of weather, carrier disruption, customs, an incorrect address, or events outside our reasonable control. We will keep you informed of material delays and provide the remedies required by applicable law.

You are responsible for providing a complete and accurate delivery address and for having permission to share a recipient’s details with us. Additional costs caused by incorrect or incomplete information may be charged to you where fair and legally permitted. Ownership and risk pass as provided by applicable consumer law and the delivery terms disclosed with your order.

Cancellations, returns, and refunds

Cancellation and return eligibility may depend on the item and how far its curation or fulfilment has progressed. Personalised, perishable, hygiene-sensitive, or time-specific products may not be returnable where the law allows, provided that restriction was clearly disclosed before purchase.

Nothing in these Terms excludes rights you have under applicable consumer law. If an item is faulty, damaged, materially different from its description, or not supplied as agreed, contact us promptly so we can offer the repair, replacement, price reduction, cancellation, or refund required in the circumstances.

Approved refunds are normally sent to the original payment method. Processing times are controlled in part by the payment provider and your financial institution, so the credit may take time to appear. If the original method cannot receive a refund, we may ask for reasonable information to arrange a secure alternative.

Accounts and acceptable use

Keep your account information accurate, your credentials confidential, and tell us promptly if you suspect unauthorised access. You are responsible for activity carried out through your account unless it results from our failure to use reasonable care or is otherwise protected by law.

You must not:

  • use the Service for unlawful, fraudulent, harmful, or abusive activity;
  • interfere with its security, operation, or other users;
  • attempt to access accounts, systems, or data without permission;
  • copy, scrape, reverse engineer, or commercially exploit the Service except where law permits; or
  • provide content that infringes another person’s rights or contains malicious code.

Intellectual property

The Service, including its branding, designs, text, software, photography, and curated presentation, belongs to us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable right to use the Service for its intended purpose while these Terms apply.

You retain ownership of content you submit. You grant us a non-exclusive licence to host, use, reproduce, and adapt that content only as reasonably necessary to operate, improve, and support the Service or comply with law. You confirm that you have the rights needed to provide it.

Our responsibility to you

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence. Nothing here limits your mandatory consumer rights.

To the fullest extent permitted by law, we are responsible only for loss that is a reasonably foreseeable result of our breach of these Terms or failure to use reasonable care. We are not responsible for indirect or consequential loss, loss caused by information you supplied, or loss caused by events outside our reasonable control. We do not exclude responsibility for loss where doing so would be unfair or unlawful.

The Service may link to or rely on third-party services, including payment and delivery providers. We remain responsible for our obligations to you, but do not control and are not responsible for a third party’s separate service, website, or independent acts.

Suspension and termination

You may stop using the Service at any time. You can ask us to close your account, subject to any open orders, outstanding payments, record-retention duties, and rights that survive closure.

We may suspend or end access where you materially breach these Terms, create a security or fraud risk, fail to pay amounts due, or where we must do so by law. Where appropriate, we will give notice and a reasonable opportunity to correct the issue. Termination does not affect rights and obligations already accrued.

Changes, governing law, and general terms

We may update these Terms as the Service or law changes. The effective date at the top shows the latest revision. If a change materially affects your rights, we will provide reasonable notice. Changes do not apply retroactively unless required by law.

These Terms are governed by the laws of the Federal Republic of Nigeria. Before starting formal proceedings, you and we agree to try in good faith to resolve a dispute by contacting the other party. The courts of Nigeria will have jurisdiction, except where the mandatory laws of your place of residence give you the right to bring a claim elsewhere or provide additional protections.

If any provision is found unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation, sale, or service transfer, provided this does not reduce your protections. These Terms and any order-specific terms are the entire agreement about the Service.
